ADRC Act of 2013

In accordance with the Constitution, Article, 21 of Section 16, states, i quote " Parliament may by law, establish impartial and independent Administration Tribunals as well as Alternative Dispute Resolution Centres " i un-quote. 

Therefore, parliament of the Kingdom of Bhutan hereby enact the Bhutan Alternative Dispute Resolution Acts of Bhutan 2013 on 5th day of 1st month of water female snake year of the Bhutanese calendar corresponding to the 25th Day of February, 2013 at its 10th session of the first parliament.

The National Judicial Commission had selected the Chief Administrator through open competition, among many, our chief was selected. On his appointment, he had worked tirelessly to establish centre without office staff and facilities. It shows his commitment towards Tsa- Wa Sum. We are bless under your dynamic leadership.

On January 2018, Six staff recruited and on 15th June 2018, centre was officially inaugurated and invited Honorable Justices from supreme court, High court, Attorney General, Arbitrators and few distinguish guest.

The centre core function is the settlement of the dispute amicably through Arbitration and Negotiated Settlement. I feels that, Royal Court of Justice and our Centre is almost same, in- terms of conducting hearing proceeding. However, the beauty of Arbitration is that, both the parties can choose their own arbitrators which is listed with the centre. The number of arbitrators must be in odd numbers including presiding arbitrators.

There are exclusion from the domestic arbitration are:

• Dispute relating to rights and liabilities which gives rise to or arise out of criminal offences.
• Matrimonial dispute relating to divorce, judicial separation, restitution of conjugal rights, child custody. 
• Guardianship.
• Insolvency. 
• Testamentary.
• Subject of inheritance.
• Subject of taxation.
• Such other matters which are against public policy, morality or any other existing provision of the law for the time being force in Bhutan. 

Therefore, Bhutan Alternative Dispute Resolution Centre is established for the people of our country to resolve the dispute which is commercial in nature amicably through arbitration process.
